Costco is suing the Trump administration in the U.S. International Court of trade, with the wholesale retailer demanding a refund on tariffs should the Supreme Court deem the levies unlawful.
According to The New York Times, Costco filed the lawsuit on November 28, over claims that President Donald Trump's tariffs enacted under the International Emergency Economic Powers Act (IEEPA) are unlawful. In its filing, Costco also voiced concerns over how the White House's trade policies have thrown global markets into chaos, and that the company's business has suffered as a direct result.
The U.S. Supreme Court heard oral arguments on November 5 in a case brought by small businesses seeking to overturn Trump's IEEPA tariffs, although it's unclear when justices will issue a ruling. Two lower courts previously ruled against the Trump administration, and during oral arguments, conservative justices — who hold a majority on the Supreme Court — seemed skeptical of the White House's authority to enact the levies.
Although Costco did not specify how much tariffs have cost the company, U.S. importers have paid nearly $90 billion in IEEPA tariffs through September, according to data from U.S. Customs and Border Protection. During a May earnings call, Costco CFO Gary Millerchip also estimated that roughly a third of the retailer's U.S. sales are from imported products, and that imports from China account for around 8% of its U.S. sales.
In a survey from consultancy firm West Monroe, 68% of manufacturing, retail and distribution industry leaders said that removing tariffs would benefit their supply chains, while 58% said that they expect to see their sales or revenues increase if the Supreme Court strikes down Trump's levies. Should justices rule against the Trump administration, an estimated 71% of White House levies issued this year would be invalidated.
